TCPA Compliance: What Every Cottage Food Seller Needs to Know

The Telephone Consumer Protection Act (TCPA) is a federal law that governs commercial text messaging in the United States. Even if you're a small home baker sending order confirmations, TCPA rules apply to you. Violations can result in fines of $500–$1,500 per message, so it's worth understanding the basics.

The most important TCPA requirement is documented opt-in. Before you send any commercial text message to a buyer, they must have explicitly agreed to receive texts from you. Keeping your opt-in page up to date with your business name and a plain-language description of the messages they'll receive is essential.

Equally critical is honoring STOP requests immediately and unconditionally. When a buyer texts STOP, QUIT, CANCEL, UNSUBSCRIBE, or END, you must stop sending them messages — no exceptions, even if they still have a pending order.
